MyOrbit Data Deletion Request Policy

At MyOrbit, you control your data. This policy explains how to delete your personal information across our messaging, AI companions, digital twins, and creator economy features. We're committed to transparency and compliance with global privacy laws while respecting your encryption mode choices.

1. Your Data Deletion Options

1.1 Refresh Account (Soft Reset)

What It Does:

  • Removes personal data (profile, content, AI training)
  • Clears your Matrix Dashboard statistics
  • Resets all AI companions and digital twins
  • Deletes Nuggets balance and transaction history
  • Preserves your username and core account
  • Maintains your verified status (if applicable)

What Remains:

  • Username and account credentials
  • Email/phone for recovery
  • Account creation date
  • Legal compliance records

Best For: Starting fresh without losing your account or verification status

1.2 Full Account Deletion

What It Does:

  • Permanently erases your entire account
  • Removes all personal data from active systems
  • Deletes all avatars and digital twins
  • Cancels active subscriptions and Orbits
  • Removes from all group chats and communities
  • Erases creator earnings history
  • Deletes all user-generated content

Effect: Complete, irreversible deletion. You cannot recover the account or any associated data.

Best For: Leaving MyOrbit permanently

1.3 Selective Data Deletion

New Option - Delete Specific Data Types:

  • AI training data only
  • Digital twin memories
  • Conversation history (AI Encryption mode)
  • Avatar customizations
  • Creator content and monetization data
  • AdWorks campaign data

Note: Not available for Superior E2EE content (we have no access)

2. How to Request Data Deletion

2.1 Self-Service (Fastest)

Via Mobile App:

  1. Open MyOrbit app
  2. Navigate to Settings → Privacy → Delete My Data
  3. Choose deletion type:
    • Refresh Account
    • Full Deletion
    • Selective Deletion
  4. Verify with 2FA (if enabled)
  5. Confirm your choice
  6. Receive instant confirmation

Via Web:

  1. Open the in-app Privacy Center (Settings → Privacy Center)
  2. Log in to your account
  3. Select Data Deletion Request
  4. Follow the guided process

2.2 Email Request

Send your request to privacy@myorbit.ai including:

  • Your MyOrbit username
  • Registered email address
  • Type of deletion requested
  • Reason (optional, helps us improve)

Verification Required: We'll verify your identity for security

2.3 Authorized Representative

Parents/guardians (for minors) or legal representatives can request deletion by providing:

  • Proof of authority
  • User identification
  • Signed authorization form (request from privacy@myorbit.ai)

3. Encryption Mode Considerations

3.1 AI Encryption Mode

  • All data types can be deleted
  • Conversation context cleared from memory
  • AI training data removed
  • Safety reports preserved (if legally required)

3.2 Superior E2EE Mode

  • Account-level data deletable
  • Message content already inaccessible to MyOrbit
  • Local device data must be cleared manually
  • Encryption keys destroyed upon account deletion

4. Processing Timeline

4.1 Immediate Actions (0-1 hour)

  • Account deactivated (if full deletion)
  • Content hidden from public view
  • Active sessions terminated
  • Subscriptions cancelled

4.2 Short-term (1-30 days)

  • Data removed from production systems
  • AI models untrained from your data
  • Third-party services notified
  • Creator revenues finalized

4.3 Complete Removal (30-90 days)

  • Backups purged (rolling deletion)
  • CDN caches cleared
  • Analytics anonymized
  • Audit logs updated

Legal Maximum: 90 days (GDPR allows 1 month + 2 month extension for complex requests)

5. Data We Must Retain (Exceptions)

5.1 Legal Requirements

  • Tax Records: 7 years (transaction data only)
  • Legal Holds: Duration of proceedings
  • Regulatory Audits: As required by law
  • CSAM Reports: Permanent (hashed, not content)

5.2 Security & Safety

  • Banned User Registry: Device/IP hashes to prevent re-registration
  • Safety Violations: Evidence for law enforcement
  • Fraud Prevention: Minimal identifiers
  • Section 230 Compliance: Moderation records

5.3 Legitimate Interests

  • Anonymized Analytics: No personal identifiers
  • System Logs: 90 days for security

6. Creator & Business Considerations

6.1 Creator Content

  • Your created avatars/twins deleted
  • Fan-created derivatives may persist (transformed work)
  • Earnings history retained for tax (anonymized after payout)
  • "Look Ma I'm Famous" boxing claims expire

6.2 Business Accounts (EchoBurst)

  • 30-day wind-down period required
  • Customer data export provided
  • API access revoked immediately
  • Compliance certificates retained

6.3 Monetization Impact

  • Pending earnings paid out
  • Nuggets balance forfeited
  • Subscriptions non-refundable
  • AdWorks campaigns terminated

7. Third-Party Notifications

Upon deletion, we notify:

  • AI Partners (OpenAI, Anthropic): Remove training data
  • Payment Processors (Stripe): Close merchant account
  • Analytics Providers: Anonymize data
  • Connected Services: Revoke OAuth tokens

We Cannot Control:

  • Content you've shared externally
  • Screenshots taken by others
  • Cached search engine results
  • Blockchain records (if applicable)

8. Your Rights by Region

8.1 European Union (GDPR)

  • Right to erasure without undue delay
  • Notification to third parties required
  • Public interest exceptions apply
  • Lodge complaints with supervisory authority

8.2 California (CCPA/CPRA)

  • Delete personal information collected

9. Special Circumstances

If you're under investigation:

  • Deletion may be delayed

  • Partial deletion possible
  • Full disclosure upon resolution

10. After Deletion

10.1 What Happens to Your Data

  • Immediate: Removed from active systems
  • 30 days: Purged from primary backups
  • 90 days: Removed from disaster recovery
  • Permanent: Audit log of deletion request

10.2 Confirmation Provided

You'll receive:

  • Email confirmation with reference number
  • List of data categories deleted
  • Any retained data explanation
  • PDF certificate (upon request)

10.3 Re-Registration

After full deletion:

  • Same email/phone can be reused after 90 days
  • Username released after 1 year
  • No data restoration possible
  • New account starts fresh

11. Frequently Asked Questions

Q: Can I reverse a deletion request?

A: Within 24 hours, possibly. After that, it's irreversible.

Q: What about my messages to others?

A: In AI mode, removed. In E2EE mode, recipients must delete manually.

Q: Will you keep charging me?

A: No. All billing stops immediately upon deletion request.

Q: Can I export my data first?

A: Yes! Use Settings → Privacy → Export My Data (GDPR/CCPA right)

Q: What if I'm a verified creator?

A: Verification cannot be transferred. Consider Refresh instead of Full Deletion.

Q: Do beta features affect deletion?

A: No. All data deleted equally, including [BETA] and [EXPERIMENTAL] features.
